These Terms & Conditions ("Terms") govern your access to and use of the DAC website, mobile experience, and related services. Please read them carefully before placing an order.
1. About DAC
This website is operated by DAC Pvt. Ltd., a company incorporated under the Companies Act, 2013, with registered office at 42 MG Road, Indiranagar, Bengaluru, Karnataka 560001, India. GSTIN: 29AABCD1234A1Z5 (illustrative).
2. Eligibility
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872. By using our services, you represent that you meet these requirements.
3. Account Registration
- You are responsible for maintaining confidentiality of your login credentials.
- Information provided must be accurate, current, and complete.
- Notify us immediately of unauthorised account access.
- We may suspend or terminate accounts for violation of these Terms or suspected fraud.
4. Products & Product Information
- We endeavour to display accurate images, colours, sizes, and descriptions. Minor variations may occur due to screen settings and manufacturing batches.
- All products display MRP inclusive of applicable taxes as per Legal Metrology Rules, unless stated otherwise.
- Availability is subject to stock. We may limit quantities per customer.
5. Pricing & Payment
- All prices are in Indian Rupees (INR) unless stated otherwise for international orders.
- Prices include applicable GST. Tax invoices are issued with every order.
- We reserve the right to correct pricing errors and cancel affected orders with full refund.
- Payment must be completed via approved methods (UPI, cards, net banking, wallets, COD where available) through RBI-authorised payment partners.
- COD orders may require OTP/phone verification at delivery.
6. Orders & Contract Formation
Your order is an offer to purchase. A contract is formed when we send order confirmation email/SMS. We may refuse or cancel orders at our discretion (stock issues, errors, fraud prevention) with prompt refund.
7. Shipping & Delivery
Delivery terms are governed by our Shipping Policy. Estimated timelines are not guaranteed but we strive to meet them.
8. Returns & Refunds
Returns and refunds are governed by our Refund & Returns Policy, without prejudice to your rights under the Consumer Protection Act, 2019.
9. Promotions & Coupon Codes
- Offers cannot be combined unless explicitly stated.
- Coupons are non-transferable, have expiry dates, and may exclude certain products.
- We reserve the right to modify or withdraw promotions without prior notice.
10. Intellectual Property
All website content — logos, text, images, designs, graphics, software — is owned by or licensed to DAC and protected under the Copyright Act, 1957, Trade Marks Act, 1999, and other laws. Unauthorised reproduction, distribution, or commercial use is prohibited.
11. User Conduct
You agree not to:
- Use the site for unlawful purposes or violate any applicable law
- Attempt unauthorised access to systems, accounts, or data
- Post false reviews, spam, or offensive content
- Use automated tools (bots, scrapers) without written permission
- Resell products purchased for personal use through unauthorised channels
12. Limitation of Liability
To the maximum extent permitted by law, DAC shall not be liable for indirect, incidental, special, or consequential damages. Our total liability for any claim shall not exceed the amount paid for the specific order giving rise to the claim. This does not limit liability for death, personal injury caused by negligence, or fraud, or rights that cannot be excluded under the Consumer Protection Act.
13. Indemnification
You agree to indemnify DAC against claims arising from your violation of these Terms or misuse of the website.
14. Force Majeure
We are not liable for delays or failures due to events beyond reasonable control — natural disasters, pandemics, government actions, strikes, or logistics disruptions.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Courts at Bengaluru, Karnataka shall have exclusive jurisdiction, subject to your right to approach consumer forums in your district under the Consumer Protection Act.
16. Dispute Resolution
We encourage resolving disputes amicably via our grievance process first. Unresolved consumer disputes may be filed with the appropriate District/State/National Consumer Disputes Redressal Commission or through edaakhil.nic.in.
17. Amendments
We may update these Terms periodically. Continued use after posting constitutes acceptance. Material changes will be communicated via website notice or email.
Government & Regulatory Compliance (India)
DAC operates in accordance with applicable Indian laws governing e-commerce, consumer protection, taxation, and digital data. Key frameworks include:
- Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020 — fair trade practices, transparent pricing, and accessible grievance redressal.
- Information Technology Act, 2000 and IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 — lawful use of platform, grievance officer, and content compliance.
- Digital Personal Data Protection Act, 2023 (DPDP Act) — lawful collection, purpose limitation, and rights of data principals.
- Legal Metrology (Packaged Commodities) Rules, 2011 — accurate display of MRP, net quantity, and manufacturer/importer details on product labels.
- Goods and Services Tax (GST) — applicable taxes are included in displayed prices unless stated otherwise; tax invoices are provided with orders.
- Payment and Settlement Systems Act, 2007 and RBI guidelines — secure electronic payment processing through licensed payment aggregators.
Consumers may also approach the National Consumer Helpline (1915) or file complaints via edaakhil.nic.in for unresolved disputes, in addition to our internal grievance process.
